Hammertoe complications

My husband had bunionectomy and hammertoe repair back in Feb 08- he has had constant pain in the foot since, the foot and entire leg are discolered (my husband is also a transplant patient) the podiatrist did a ct scan because my husband has a defibrillator as well he now has osteomyelitis in the toe? Should we seek counsel, this has been going on for months my husband was hospitalized in June with a septic knee no cause for the infection was found.
