You tried protection and it failed so it acted like unprotected sex and any time you have unprotected sex there is always a chance of pregnancy occurring.If you are pregnant it will be too early to test for at least a month. You can buy a home pregnancy test and use in a month with the first urine of the day as that highest concentration of pregnancy hormone HCG.Hope this helps and good luckP.S.
