If I was sober I wouldn't have had sex with him. Is this rape?

are you a freshmen in high school? because then you can get the school involved for bullying. BTW how old are you? if this is high school you are too young to consent to sex and it is Statutory Rape. Even if you said you wanted to have sex the law does NOT see it that way. If you dont want him to go to jail and live as a sex offender the rest of his life you should just get a restraining order on him, trust me, a judge will have no problem granting that. 

do not press charges for revenge though. it is a serious situation and him going to jail will mess up his whole life. I know he's a total s**m bag, but a restraining order will do just fine and then you can press charges if he violates it. 

Yes, I am a freshmen in high school. I am 15 years old actually. So this would be basically considered rape? It's been around the whole school of my as a rape victim. I was wondering because words hurt. I wouldn't press charges or anything because that would cause a lot of problems. I mean I feel like it's my fault because it was my first time getting drunk & I should have known. But when people ask, I'm just like I don't know.... :/

He took advantage of you because you were drunk. Maybe try talking to him. You can always tell him what happened was a mistake; if he doesn't listen then you can tell him what he did was illegal and if he doesn't stop that he could get himself into trouble, when teachers/adults at schools hear about these kinds of things they have to report them. They can't just let them slide.
Schools are also highly against bullying now, try talking to your guidance counselor, if you have one, they can help with a more hands-on approach to help fix/solve the problem.

The same thing happened to me, except I'm a year younger than you and i was on pills. He had given a lot to me, and after an hour i started feeling like sh*t and i could barley move or talk. I was so out of it. We ended up having sex, I'm almost fourteen and he's 17. Now he's going around telling everyone, but I would not have f*cked him if I was sober. I just forgot about it, (it happened in August, when he was 16) because eventually it'll blow over. But you could honestly press charges for it if you wanted, but like you said it would create a lot of drama. It is a very embarrassing and awkward situation to be in, and if you regret it like I do, it completely sucks ! If you need someone to talk to or vent to, I'm here (: Stay strong <3
