Hi, I had a case like yours, but you should discuss the case with your lawyer to see what are your chances to win the case. You have legal right to ask for indemnity, but you must keep in mind that courts are very slow, and it takes months sometimes even years to close a case. If you have medical findings of your condition before and after surgery, and other proves like opinion of other dentist claiming that your surgery was not done in right way, you have all chances to win. Anyway, you can’t expect that your dentist will not defend himself , by prolonging or even not appearing on the court, defending by getting support for his work, since all doctors support each other and stand for each other.
