No one can say that it is 100% safe for you to have sex on day 3 of your period. It depends upon a number of variables but primarily when you ovulate. Since that varies among different women, it's an unknown.
It is unlikely you'd get pregnant but with ANY sexual contact there is always a chance of pregnancy.
