What do you mean "pregnant 12th december?" Is that when you found out you were pregnant or did someone tell you that you got pregnant on the 12th?
If you found out on the 12th, then it is the sex in NOVEMBER that got you pregnant. You would not have known, no test can tell, if you were to get pregnant 3 days (sex on the 9th) after having sex.
If someone told you that you got pregnant on the 12th, I'm assuming a doctor or nurse, then it could be either guy. Even pulling out may not prevent pregnancy. A DNA test would be needed to identify the father.
