A witness in a trial with which I am involved sustained a TBI in December 2009. He still has no memory of any events that occured before this accident. If he does not regain his memory, there is no witness, and the trial must be dismissed. It is very expensive to draw the trial out in hopes he will recover his memory. He is only now becoming able to speak and eat on his own. I have heard that with brain damage that involves memory loss of this sort, it is extremely unlikely that he will recover his memory. Is it very unlikely that he will recover his memory for events prior to his accident if he sustained a severe TBI and, after 8 months, still has no memory?
